  RULES AND REGULATIONS OF THE CHAMBER Ispiši dokument

I. GENERAL PROVISIONS

Article 1

The purpose of these Articles of association is to govern the internal structure of the Croatian Chamber of Architects and Civil Engineers (hereinafter: Chamber), forms of association of authorized architects and authorized civil engineers on the territory of one or more local self-governing units, as well as the procedure of making entries into the Registers and Lists of the Chamber, manner of keeping the Registers and Lists, professional tasks and orientations of authorized architects and civil engineers, disciplinary procedures for establishing violations of duty and damage made to the reputation of authorized architects and civil engineers, bodies for initiating and conducting disciplinary procedures, the structure of Chamber’s administrative and professional service, as well as other issues relevant to its members, unless otherwise provided in the Act on the Croatian Chamber of Architects and Civil Engineers.

Article 2

1) In accordance with the Constitution, the Act on the Croatian Chamber of Architects and Civil Engineers, other regulations and these Articles of association, Professional ethics code and other acts of the Chamber, the Chamber shall foster architectural and civil engineering professions, for the purposes of protecting public interests, as well as the interests of third persons.
2) The Chamber shall pay special attention to:
1. safeguarding the reputation, honor and rights of authorized architects and authorized civil engineers, providing the conditions for adequate performance of professional jobs of urban development, designing, professional supervision and project control,
2. monitoring authorized architects and authorized civil engineers, joint offices, designing companies, i.e. other legal persons for which authorized architects and authorized civil engineers perform their work in accordance with the Act,
3. continuous professional betterment of its members and candidates for members of the Chamber, for the purposes of which it shall found and enhance various forms of professional and scientific cooperation with the ministry of urban development, construction and habitation of the Republic of Croatia (hereinafter: Ministry), administrative bodies, faculties, associations of architects and/or civil engineers, etc.
4. developing professional ethics,
5. keeping track of and studying relations and terms, including the state of the construction business of interest to structuring, positioning and work, as well as the enhancement of architectural and civil engineering activities,
6. informing Croatian national parliament and representative bodies of local self-governing and government units, either of its own free will or at their request, of the state, problems and measures to be taken to better the construction business, and accordingly, protect the environment, protect and preserve cultural heritage and protect the environment from devastation by building,
7. fostering material and other interests of authorized architects and authorized civil engineers,
8. protecting the status and rights of retired authorized architects and authorized civil engineers,
9. establishing and developing cooperation with other Chambers of architects and/or civil engineers, as well as international organizations of architects and/or civil engineers and other professional organizations and associations.

Article 3

Authorized bodies of the Chamber, unless otherwise provided by the Act, these Articles of association or some other general act of the Chamber, when it comes to procedures for entry into the Register of authorized architects and a Register of authorized civil engineers, shall decide on the renewal of the process of entry, as well as rights and obligations of authorized architects, civil engineers and designing companies, in accordance with the rules and regulations of the General administrative procedure act.

II. ENTRY INTO REGISTERS AND LISTS OF THE CHAMBER

Article 4

1) Right to performance of professional jobs of physical planning, designing, expert supervision and control of projects, pursuant to special regulations, and depending on professional orientation of authorized persons, as well as the right to use professional titles of “authorized architect” or “authorized civil engineer” shall be gained upon entry into the Register of authorized architects and a Register of authorized civil engineers.
2) On the occasion of making each individual entry, a decision and architect or civil engineering membership card (hereinafter: membership card) shall be issued to authorized architect and/or civil engineer.
3) Membership cards shall contain the title “Croatian Chamber of Architects and Civil Engineers”, sign of the Chamber, designation “architect membership card”, i.e. “civil engineer membership card”, card number matching the number of entry into the Register of authorized architects, i.e. a Register of authorized civil engineers, designation “authorized architect”, i.e. “authorized civil engineer”, first name, family name, day and place of birth, academic degree, professional orientation and main office of authorized architect and/or civil engineer, his/her photograph, signature and date of issue. If authorized architect, i.e. authorized civil engineer is a member of a designing company or employed in such a company, i.e. if he/she works in some other legal person, the membership card should also contain data concerning the company, that is the other legal person, as well as the position authorized architect and/or civil engineer holds in that company.
4) Membership card shall be verified by Chamber’s seal, stamped over lower right corner of the photograph of authorized architect, i.e. authorized civil engineer and signature of the president of the Chamber.
5) Should a change of data from the membership card occur, authorized architect, i.e. authorized civil engineer shall, without delay, request the issue of a new membership card.
6) Should authorized architect, i.e. authorized civil engineer cease to perform his/her job, he/she shall return the membership card to the Chamber.
7) Authorized architect, i.e. authorized civil engineer shall meet the costs of issue of his/her membership card.
8) The Managing Board shall decide on the size and shape of membership cards.

Article 5

1. Application for entry into the Register of authorized architects and a Register of authorized civil engineers shall be delivered to the Chamber, i.e. Committee for entry into Register.
2. In his/her application, any architect or civil engineer who works independently, shall designate a place in which he/she intends to open his/her office, i.e. the office in which that architect or civil engineer intends to work.
3. Apart from the application and documents from Article 26, paragraph 2 of the Act on the Croatian Chamber of Architects and Civil Engineers, applicants shall also deliver proof that the person applying for registration meets the requirements for performance of professional jobs of physical planning, designing, expert supervision and project control. If architect or civil engineer intends to work for a designing company, he/she shall also deliver proof that he/she shall acquire the member status, i.e. be employed by that company if he/she is entered into the Register of authorized architects or one of the Registers of authorized civil engineers.
4. The Committee for entry into the Register of authorized architects and the Chamber of authorized civil engineers shall consider the application.
5. Applicants shall not have the right to appeal against Committee’s decision from paragraph 4 of this article, denying entry into the Register of authorized architects or a Register of authorized civil engineers, but shall have the authority to initiate an administrative suit.
6. Administrative suit shall be initiated by means of a suit brought before the Administrative court of the Republic of Croatia, no later then 30 days from the day of delivery of decision from paragraph 5 of this article.

Article 6

1. When deciding on any application for entry into the Register of authorized architects or a Register of authorized civil engineers, the Chamber shall have the right to ask the applicant to supplement the evidence concerning his/her right to be entered into the Register of authorized architects or a Register of authorized civil engineers.

Article 7

1. Partial schooling and work on only one type of professional tasks, limited number of or simple professional tasks shall not be considered adequate meeting of conditions for entry into the Register of authorized architects or a Register of authorized civil engineers.
2. If an architect takes lessons concerning construction calculations, installation planning or geodesy he/she shall neither be qualified for entry into a register of some other profession, nor for the performance of professional tasks of any department he/she is not a member of.
3. If a civil engineer takes lessons concerning architecture, physical planning or some other engineering profession, he/she shall not be considered qualified for entry into a register of some other profession, nor for the performance of professional tasks of any department he/she is not a member of.
4. By way of exception, an architect or civil engineer can be entered into a register of some other profession, provided that the quality of his/her work proves that he/she has acquired adequate practical experience for the performance of professional tasks of the department he/she wishes to become a member of. Committee for entry into that particular register shall decide thereof.
5. Right to entry into the Register of authorized architects in the profession of authorized landscape architects shall be granted to any person who graduated from an adequate college of biotechnical sciences, thus acquiring the title of graduate agronomist – landscape architect.

Article 8

Any person who does not meet the requirements from Article 26, paragraph 5 of the Act on the Croatian Chamber of Architects and Civil Engineers can be allowed entry into the Register of authorized architects or a Register of authorized civil engineers, provided that person delivers written recommendations of three authorized architects or civil engineers, if he/she has a minimum of ten-year professional work experience at professional tasks of a specific orientation and if he/she passes an exam compiled in accordance with a special program chosen by the Assembly of the Chamber.

Article 9

The procedure of considering applications for entry into the Register of authorized architects or a Register of authorized civil engineers shall be discontinued if a criminal investigation is launched against the applicant, concerning criminal action which makes the applicant unworthy of the performance of jobs in architecture or civil engineering or if a disciplinary procedure is initiated against the applicant in the body or legal person in which he/she is employed or which he/she is a member of.

Article 10

If the Committee for entry into the Register of authorized architects or a Register of authorized civil engineers fails to decide on a proper application within 60 days from the day of delivery of that application, and there are no reasons for the postponement of such entry, the applicant shall have the right to initiate an administrative suit, as if the application had been rejected. In that case, the procedure before the Administrative court shall be considered urgent.

Article 11

1) If, following the granting of entry the applicant is found not to meet the requirements for entry into the Register of authorized architects or a Register of authorized civil engineers, the entry procedure shall be reopened at the request of the disciplinary prosecutor, Managing Board or minister of urban development, construction and habitation.
2) Provisions relating to entry into the Register of authorized architects or a Register of authorized civil engineers shall be applicable, in an adequate manner, to the reopened procedure.
3) The decision whether the earlier decision to enter the architect or civil engineer into the Register of authorized architects or a Register of authorized civil engineers shall stay in force, or be annulled and architect or civil engineer expunged from those registers shall depend on the results of the reopened procedure.

Article 12

Provisions of these Articles of association governing the reopening of entry procedure shall be applicable, in an adequate manner, to the procedure of expunging persons from registers.
