III.CHAMBER DOCUMENTS

ARTICLES OF ASSOCIATION

Article 20

(1) The articles shall specifically regulate:
- the Chamber organisation structure,
- forms of association of certificated architects and certificated engineers, in one or several local administrative units,
- the registration procedure into the Chamber registers and lists,
- entries into registers and lists,
- the professional tasks and specialisation of certificated architects and certificated engineers,
- the disciplinary procedure in order to determine possible violation of duties and its impact on the members' reputation
- the bodies to initiate and conduct the disciplinary procedure,
- the organisation of the Administrative and professional service of the Chamber,
- other issues concerning its members.
(2) The Chamber Assembly shall pass the Articles following the authorisation of the Ministry of Physical Planning, Building and Housing** (hereinafter: the Ministry).
(3) The Articles shall be published in the «Official Gazette»

CODE OF CONDUCT

Article 21

(1) The Code of conduct shall regulate the principles and regulations binding for the Chamber members in their work.
(2) The Code of conduct shall be passed by the Chamber Assembly following the opinion of the Ministry.
(3) Exceptionally, departments can pass additional regulations within their scope of activity; these regulations shall be binding for the department members but shall not contravene the Chamber Code of conduct.
(4) The Code of conduct shall be published in the «Office Gazette».

TARIFFS FOR SERVICES

Article 22

((1) The Chamber Assembly shall decide on tariffs and shall pass the Regulations on tariffs for their services, following the opinion of each department and the approval of Ministry.
(2) The regulations from Paragraph 1 from this Article are published in the «Office Gazette».

IV. REGISTRATION IN THE CHAMBER REGISTER

REGISTERS AND LISTS

Article 23

(1) The Chamber shall keep the Register of certificated architects and separate registers of certificated engineers, specifying their specialisation, scope of activity and the manner of performing the jobs, as well as the List of design companies.
(2) The Chamber keeps a record of disciplinary procedures related to the members no longer in the Register and other records, as regulated by the Articles.
(3) The Register, the List and the records from Paragraph 1 and 2 of this Article are public documents. Extracts from the Chamber Register, Lists and records, as well as all certificates issued on the basis of this data are public documents.

PROFESSIONAL TITLE

Article 24

(1) The right to use the professional title of «certificated architect» and «certificated engineer» is acquired by entering the Register of certificated architects and the Register of certificated engineers.
(2) The decision on entering the registers from Paragraph 1 of this Article is the responsibility of the relevant Chamber body in accordance with the Articles.

Article 25

(1) A certificated architect or a certificated engineer can perform those jobs for which he has been qualified or for which he has been trained in service.
(2) The specialisation of a certificated architect or certificated engineer is regulated by professional tasks.
(3) The professional tasks required for each specialisation of a certificated architect or certificated engineer are regulated by the Articles.

REQUIREMENTS TO ENTER THE REGISTER

Article 26

(1) Certificated architects and certificated engineers acquire membership in the Chamber by entering the Register of certificated architects or certificated engineer.
(2) Persons entitled to enter the Register of certificated architects or certificated engineers shall meet the following requirements:

1. Croatian citizenship,
2. competence for the job,
3. physical fitness for the job,
4. a degree from the appropriate technical faculty of the Republic of Croatia with the title of graduate engineer (in architecture, civil engineering, surveying, mechanical engineering or electrical engineering),
5. at least three years of working experience after graduation, under the supervision of a certificated architect or certificated engineer
6. the certification examination for jobs in the construction sector, or any other relevant certification examination,
7. that there are no court proceedings against the candidate,
8. that the candidate is worthy of performing jobs in the architecture and civil engineering sector,
9. that the candidate does not perform jobs that are incompatible with the profession.

(3) If the candidate applying to enter the Register has graduated from a foreign university or a relevant foreign institution, he is deemed to have met requirements from Paragraph 2, line 4 of this Article with the obligation to validate his certificate in compliance with national regulations.
(4) The entry into the Register of certificated architects or certificated engineers can be granted to architects or engineers who are foreign subjects not meeting the requirements from Paragraph 1 of this Article when such candidates are members of the Chamber of architects or engineers in their country under the conditions of reciprocity.
(5) Exceptionally, the entry into the Register of certificated architects or certificated engineers can be granted to persons not meeting the requirements from Paragraph 2, line 4 of this Article, if they have at least ten years of working experience in the profession on jobs from Article 1 Paragraph 2 of this Act, and if they have specially excelled in their work.
(6) The terms and conditions to enter the Register of certificated architects or certificated engineers for persons from Paragraph 5 of this Article are brought by the Chamber body in accordance with these Articles.

UNWORTHINESS FOR PERFORMING JOBS

Article 27

A person is deemed unworthy of performing jobs in the architecture or civil engineering sector if sentenced for crime against the Republic of Croatia, for crime against his profession, a crime committed for gain, which, according to the Code of conduct, qualifies him as morally unworthy to perform jobs in the architecture and civil engineering sector.

REJECTION OF REGESTRATION APPLICATION

Article 28

(1) A registration application shall be rejected if the applicant to the Register does not meet the requirements from Article 26, Paragraphs 2, 3 and 5 of this Act.
(2) In case the registration application is rejected due to reasons arising from Article 26, Paragraph 2, lines 8 and 9 of this Act, a new registration application can be submitted not earlier than two years after the first rejection has become valid.

SUSPENSION OF MEMBERSHIP IN THE CHAMBER

Article 29

(1) A certificated architect or a certificated engineer shall have his membership suspended in case:
1. he is detained pending trial,
2. he has been elected or appointed to a paid public office,
3, he has joined government administration or local government.
(2) The decision on membership suspension shall be taken by the Chamber body as regulated by the Articles
(3) During suspension, all other rights and obligations deriving from the membership in the Chamber shall be suspended,
(4) Following the termination of the suspension, the certificated architect or a certificated engineer shall acquire the rights deriving from membership in the Chamber

TERMINATION OF MEMBERSHIP

Article 30

Membership in the Chamber and the right to perform jobs falling under the competence of a certificated architect or a certificated engineer shall be terminated by deleting the person's name from the Register in case:
1. of termination of Croatian citizenship,
2. his/her competence for the job is fully or partially restricted,
3. he/she becomes physically unfit for the job
4. he/she has been suspended for safety reasons,
5. he/she has been suspended for disciplinary reasons,
6. he/she submits an application to terminate membership in the Chamber,
7. he/she has stopped performing jobs for over six months for no valid reason,
8. of prison sentence over six months,
9. he/she performs jobs incompatible with the profession.

Article 31

(1) Pursuant to Article 30 of this Act, a certificated architect or a certificated engineer shall terminate his professional activity in case:
1. of termination of Croatian citizenship from the day it becomes legally valid,
2. of fully or partially losing the right to perform jobs falling under his competence, from the day it becomes legally valid,
3. of suspension for safety reasons, from the day it becomes legally valid,
4. of suspensions for disciplinary reasons, from the day it becomes legally valid,
5. he has been sentenced to over six months imprisonment, from the day it becomes legally valid,
(2) In all other cases, a certificated architect or a certificated engineer shall be suspended from performing the professional activities from the day he has received such a decision from the Chamber body as defined by this Articles.

RE-ENTRY IN THE REGISTER

Article 32

(1) The person whose membership has been suspended shall not re-entry the Register in case:
1. he has been suspended for safety reasons before the termination or the expiration of the suspension,
2. he has been suspended disciplinary reasons before the expiration of the suspension period,
3. he declares in writing that he no longer wants to be engaged in his profession, or if he has not been engaged in his profession for over six months for no valid reason, within six months from the day such a decision was made.
(2) In all other cases, a certificated architect or a certificated engineer whose membership in the Chamber has been suspended or who has been suspended from performing jobs falling under the competence of a certificated architect or a certificated engineer may apply for re-entry in the Chamber Register when the reasons causing his suspension no longer exist.

NOTIFICATION TO THE CHAMBER ON LEGAL ACTION

Article 33

A law court or any other state body is obliged to notify the Chamber about starting an offence procedure or criminal proceedings against a certificated architect or a certificated engineer, about his being detained pending trial, about his being sentenced, and about the termination of the legal action against the certificated architect or the certificated engineers.

APPEAL

Article 34

An appeal against the Chamber decision on membership, its suspension or termination is not accepted but an administrative procedure can be started.
